Terms & Conditions

These Terms and Conditions ("Terms") govern the relationship between Garage Sky Co., Ltd. (ガレージスカイ合同会社, "Garage Sky", "we", "our", or "us") and any person or entity ("Buyer", "you") who engages our services for the sourcing, purchase, and export of used vehicles from Japan.

By submitting an inquiry or entering into a transaction with Garage Sky, you agree to be bound by these Terms. Please read them carefully.

1. Nature of Service

Garage Sky operates as a sourcing intermediary and export coordinator. We do not maintain a physical stock of vehicles. Upon receiving your inquiry and agreed requirements, we source vehicles on your behalf through Japan's domestic auction network and/or private trade-in channels. Title to any vehicle passes directly through the transaction; Garage Sky facilitates but does not act as the final seller of record for customs purposes in all cases.

We work with licensed export partners to handle the physical export, shipping documentation, and vessel booking.

2. Quotations & Pricing

All prices are quoted in United States Dollars (USD) unless otherwise agreed in writing. Quotations are valid for the period specified in the quote document and are subject to change based on auction results, exchange rate fluctuations, and inventory availability.

Quoted prices typically include the vehicle purchase price and our service fee. The following are not included in quoted vehicle prices unless expressly stated:

• International freight and shipping charges
• Marine insurance
• Export documentation fees
• Import duties, taxes, and customs clearance fees in the destination country
• Local registration, inspection, and compliance fees

3. Payment Terms

Payment is required in full via Telegraphic Transfer (T/T) bank wire transfer before any vehicle is acquired on your behalf. We do not place bids at auction or commit to any direct purchase until full payment has been received and cleared.

Bank charges, conversion fees, and transfer costs are the responsibility of the Buyer. Payments must be received in the full quoted amount net of any deductions.

4. Vehicle Sourcing & Auction Process

When a vehicle is sourced through Japan's auction network, the following conditions apply:

• Auction results are not guaranteed. Vehicles may be sold to another bidder or may not reach the seller's reserve price.
• Auction inspection sheets (sheets produced by the auction house) are shared with the Buyer before any bid is placed where available. These sheets represent the auction house's assessment and are not a warranty by Garage Sky.
• In the event a bid is unsuccessful, we will immediately work with you to identify a suitable alternative vehicle.
• If no suitable alternative is agreed upon after reasonable efforts, all funds received will be returned to the Buyer in full.

5. Vehicle Condition

All vehicles are used. Condition is assessed based on Japan Auction Standards grading (Grade 4–5 as standard, Grade 4 available upon request) or equivalent inspection documentation for direct purchases. Garage Sky will share all available inspection records with the Buyer prior to confirming any purchase.

Garage Sky provides no warranty on vehicles beyond the accuracy of the information contained in the inspection documentation provided. Buyers are advised to review all inspection records carefully before confirming.

We are not responsible for defects or issues that arise after export, during shipping, or as a result of local inspection or compliance requirements.

6. Cancellations & Refunds

The following cancellation policy applies:

• Before vehicle acquisition: Cancellation requests will be reviewed on a case-by-case basis. Any costs already incurred on your behalf (e.g., auction registration, administrative fees) may be deducted from any refund amount.
• After vehicle acquisition: Cancellations are not accepted once a vehicle has been purchased or committed to at auction, except in cases where the vehicle materially fails to match the inspection documentation provided.
• Unsuccessful sourcing: If we are unable to source a suitable vehicle and no alternative is agreed upon, all funds will be returned to the Buyer in full.

7. Export & Shipping

Garage Sky coordinates export and shipping through licensed export partners. While we manage this process on your behalf, we are not a shipping company and are not responsible for:

• Delays caused by port congestion, vessel scheduling, or force majeure events
• Damage occurring during ocean freight (marine insurance is strongly recommended)
• Customs delays or clearance issues in the destination country

Bill of Lading and shipping documents will be provided to the Buyer upon availability after loading.

8. Import Compliance

The Buyer is solely responsible for ensuring that the vehicle is legally importable into the destination country, including compliance with RHD regulations, emissions standards, safety requirements, and any other applicable rules. Garage Sky provides no advice on import legality in any jurisdiction.

Note regarding the United Arab Emirates: right-hand drive vehicles are not eligible for standard road registration in the UAE. Buyers acquiring vehicles via UAE typically do so for the purpose of re-export to third countries across the Middle East, Africa, or elsewhere. It is the Buyer's sole responsibility to confirm the intended use, local regulations, and re-export procedures applicable to their transaction.

9. Export Controls & Prohibited Destinations

All transactions are subject to Japanese export control laws, including the Foreign Exchange and Foreign Trade Act (外国為替及び外国貿易法, FEFTA), and applicable international trade regulations.

Garage Sky does not export or facilitate the export of vehicles to the following destinations, and any inquiry or order involving these destinations will be refused:

• Russia and Belarus — subject to Japanese government export prohibition measures effective 2022 onwards
• North Korea (Democratic People's Republic of Korea) — subject to comprehensive export ban under Japanese law
• Iran — subject to UN and Japanese government sanction measures
• Any other country, entity, or individual designated as a restricted or sanctioned party under Japanese law or applicable international sanctions regimes at the time of the transaction

The Buyer represents and warrants that the vehicle will not be re-exported to any prohibited destination, directly or indirectly. Garage Sky reserves the right to cancel any transaction and refund any funds received if, at any stage, we determine or reasonably suspect that a transaction may involve a prohibited destination or end-use.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Garage Sky's total liability to the Buyer in connection with any transaction shall not exceed the total amount paid by the Buyer to Garage Sky for that specific transaction.

We are not liable for any indirect, consequential, or special damages, including but not limited to loss of profit, loss of use, or loss of business opportunity.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes arising from or in connection with these Terms or any transaction shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Nagoya, Aichi, Japan.

12. Amendments

Garage Sky reserves the right to update these Terms at any time. The current version will always be published on this page. Continued engagement with our services after an update constitutes your acceptance of the revised Terms.
